Off-Duty Officer Had Been Drinking, But Below OWI level before Hitting House with a Car

CLINTON CO. - An off-duty DeWitt Township police officer told a deputy that he had been drinking before he crashed the car he was driving into a house, but a breath test showed he was under the limit. A statement sent to News 10 by the Clinton County Sheriff's Office says Sgt. Jason Jones of the DeWitt Township police department told the investigating deputy that he hit the gas instead of the break, as he was driving through a curve at about 1:45AM Saturday, August 18. His car left the roadway and struck the garage of a home in the 3900 block of Norway Pine Drive in DeWitt.
"The driver of the vehicle, Jason Jones, admitted to drinking alcohol and at his request was administered a Preliminary Breath Test by DeWitt Township Police Officers prior to Sgt. Spitzley's [Clinton County Sheriff's Office investigating officer] arrival. The results of which were below the level required for Operating While Intoxicated," the statement reads.
The statement goes onto say that the investigating officer for the sheriff's department, Sgt. Dan Spitzley also concluded that Jones was not intoxicated.
A report will be submitted to the Clinton County Prosecutor's office for review.
The crash caused damage to the home's garage and yard. A woman was asleep inside the home at the time. No one was hurt.

    Well look down south to Lansing. They just arrested and charged one of their own with DWI. Takes guts to do the right thing but it was the right thing to do. Just goes to show you what a bunch of small town hacks we are dealing with in Dewitt. Shame, shame, Shame You guys are gutless and an embarassment to the profession!!

      My bad, it was a Dewitt officer that arrested the LPD officer. Hey Dewitt PD, his foot just slipped from the brake to the gas, you should have cut HIM some slack....What a farce!!!!!!!!!

    Ok, i'll say it. I am ashamed of these officers but i expect it from them. I am more ashamed of LSJ for not saying what everybody else is saying, what everybody else knows.A ten year old could figure this one out.it's like watching an episode of Cops, except this time the cops are the ones with really bad excuses. Disgusting. Shame, shame, shame!!!

    Wow the lies get deeper. "Gas instead of brake" really? Delay in pbt or not given...hmmm, .07 not .08, how convenient. Admits to drinking but not that much? Well they've covered all the bases. Legitimate excuse as to how it may have happened. Admited to drinking but blew under limit, that takes out any witness that will come forward saying he was drinking or they served him.Locked witnesses away from scene. What a shame that they all live by the "do as I say" principles. Another black eye for the cops...liars! Oh BTW "Buzzed driving...." nice:/

    Justice served. He got a ticket. he was .01 away from being legally drunk. I wonder if we would have been released and got a reckless driving ticket. probably not. He is only human with desires to relax and have a good time. Glad he is OK and no one harmed. You can bet he will be a better driver from now on. Good Luck.

    Shocking....didn't Spitzley get the "Officer Of The Year" Award a few years ago based on his DUI/OWI arrests? I suspect Dewittiot Township PD had something to do with that? Maybe paying back the reward....?

    What a black eye it places on the law abiding officers. Who in there right mind has any respect for either of these agencies after this. Shame on all you involved with this cover up. I hit the gas instead of the brake and traveled off the street! Judgement was not impaired by being drunk? Lets be real..........

    It took 50 minutes for Dewitt Township police to respond?? A fellow officer in need and a 50 minute response time?? I highly doubt this. Had to be a reason. Time to sober up maybe?

    wow so glad you morons have never done anythign wrong before in your life. Put down the stones, the driver took responsibility for the accident, called police, freely took the breathlizer and was safe. the hosue is 30 feet from the round on an exceptionally sharp corner. no one was hurt or killed in the accident, let's leave it that way. leave the officer alone. how many of you would have done the right thing by calling the police like he did....yeah end of story.

      Nice try, Joe. If you would have ran into the house you'd be nailed to a cross by the cops, but there's been no update as of ANY actual charges against the cop (If there is then I stand corrected, but I haven't heard anything as of yet). Do you think YOU wouldn't be sitting in jail if YOU had done the same thing??--I don't think so. The point everyone is making here is that the cops protect their own and this is another example of it.

    How about a charge of Driving While Visibly Impaired? Under State law any driver that is visibly impaired can be charged with that. He admitted to having a drink and he crashed his car into a house. He sounds like he was visibly impaired to me.
