Thirty-three-year-old Sherry Ley was formerly charged Tuesday with driving while intoxicated and causing the death of her son in an accident.
Ley was at the wheel of her SUV on June 15 when it spun out of control and crashed on Pope Church Road in Springport.
Ley's 10-year-old son Justin was thrown from the vehicle and killed. Police say he was not wearing a seatbelt.
