Battle Over Benefits for Same-Sex Couples

A judge must now decide what voters intended when they passed Proposal Two in November. The proposal bans gay marriage in Michigan, but does it also ban benefits to same-sex couples?

State Attorney General Mike Cox says the constitutional amendment means public employers can no longer offer health insurance and other benefits to partners of gay employees.

Tuesday afternoon attorneys for 21 same-sex couples and Gov. Granholm asked that Circuit Court Judge Joyce Draganchuk rule that employers can continue to offer the benefits.

Judge Draganchuk said she'll consider both sides' arguments carefully before ruling. No timetable was announced.
