Former Okemos high school teacher William Bryan Polston has already been charged in Eaton County - where he lives - with six counts of criminal sexual conduct against a minor. Now, said the Ingham County Prosecutor, his office is also investigating.
"It would depend on what crime was committed and the age of the girl when it happened," Stuart Dunnings said.
Dunnings could not speak about the open investigation, but did say the statute of limitations to charge Polston has not run out.
Documents we received under the Freedom of Information Act indicate a sexual relationship happened in 2003 and 2004.
"It's not too long, no," Dunnings said.
Court documents said the woman in this case went to an attorney back 2008/2009, and at that time, the woman believed too much time had passed for a criminal case. So instead, both parties agreed to settle for $70,000 and never speak of the case.
Checks, seized by police, show Polston did begin to pay the woman and her attorney.
That attorney -- Randie Black -- said her involvement in the case was purely civil, That settlement, she said, did not stop the woman from going to police.
Her statement to News Ten reads in part....
"I represent victim's in civil cases. That's what I do. I don't make victims and I won't re victimize anyone. I give them their options, they make their own decisions and they sign a statement to that effect. I settled a civil case and that's what's gone. It has nothing to do with the criminal case."
Ultimately the woman in this case didn't go to police. It was a third party within the school district.
Prosecutor Dunnings said there is no legal obligation for lawyers to report crimes to police.
The statute of limitations for CSC cases varies. For CSC-1 cases, there is no limitation, for CSC-2/3/4, it is 10 years or until the victim is 21-years-old.
Prosecutors believe they are well within their rights to file charges against Polston in this case.
