Court documents from 2008 show the woman in this case went to an attorney looking for representation.
In the Meridian Township Police Department's Victim's Statement, she told police she was advised by her attorney -- Randi Black -- that the statute of limitations had passed to bring criminal charges against Polston -- and doing so would only re victimize her.
According to her statement, she was advised by her lawyer to instead take money to keep the case quiet and out of court. She goes on to tell investigators the attorney advised her to tape phone conversations with Polston.
According to the police transcript of one conversation, the former student asks " I'm just asking, like from your perspective, like being an adult, I'm just wondering what you're thinking."
Polston responded: "Well obviously ultimately I wasn't. I can't justify it."
Throughout several pages of the conversations, Polston never admits to a sexual affair, but does apologize. At one point he says...
"I'm sorry if you feel bad. And later on he said: "I just feel bad right now."
The settlement agreement shows both parties agreed to a $70,000 payment spread over ten years -- ending in 2019. In a letter dated May 14th 2009, the attorney stresses to the client: "this means this case is gone forever."
Over six months of investigation beginning in December of 2009, Meridian Township Police seized Polston's financial records, which show he wrote two checks to the woman and her attorney, one for $5,400 on May 6, 2009, the other for $4,600 on May 15th.
Those same records show Polston was paid nearly $5,000 from a life insurance company, $4,300 from another financial institution. There are several other checks written by Polston back to the life insurance company.
On May 12, 2010, a letter shows the former student requested all the information from the settlement and recorded conversations from her attorney.
According to the police report -- the woman talked to a teacher from Okemos high last year, and that teacher went to the police.
In 2008, Polston got a letter from Deputy Superintendent Catherine Ash detailing a discussion they had in which he was told he was quote "engaging in behavior that pushes the professional boundaries between teacher and student". Ash also told him to stop texting students with personal comments and to stop talking about his personal life with them.
