Prosecutor: Officer Was Justified in Firing Fatal Shot
MSP and Jackson County Sheriff's Department find that the shooting of Elvin Potts was justified. Potts killed Officer James Bonneau and injured Officer Darin McIntosh last week.

Michigan State Police and the Jackson County Sheriff's Department ruled today that a shooting that left a man and a Jackson Police Officer dead and a Blackman Township Officer wounded was justified.

"After full review of all known facts in this case I and my senior staff find the use of deadly force by the surviving officer to be justified under Michigan law," said Jackson County Prosecutor Hank Zavislak.

Seven shots were fired between Elvin Potts and Officer Darin McIntosh. McIntosh responded to a domestic dispute at Potts' house, and was there for about 3 minutes before Officer James Bonneau arrived.

When Bonneau came, Potts charged at both officers and they wrestled him to the ground.

McIntosh was able to handcuff one of Potts' wrists, but Potts was able to still grab a gun. That's when he shot at McIntosh and missed, and shot a second time at Bonneau, killing him.

McIntosh returned fire, but missed Potts. Potts was able to shoot one final time at McIntosh, injuring him in the thigh. McIntosh fired back, killing Potts.

"It's clear to me that had Officer McIntosh not returned fire of the assailant, we would have attended two police funerals," said Zavislak. "The officer fired in self defense of himself and his fellow officer after both of them had already been shot by the suspect."
