The state Attorney General's office would receive funding to appeal the ruling against the state's drug testing program for welfare recipients to the U.S. Supreme Court.

That's according a provision in next year's general government budget approved today by the state House.

A spokesman for Attorney General Mike Cox said the AG is considering appealing the decision by a federal appellate court in April that ruled the program was unconstitutional.

Michigan's drug testing program began in 1999, but only lasted five weeks before it was halted by a federal court judge.

There's $150,000 in the nearly $3 billion general government budget for the upcoming fiscal year for the drug testing appeal.

The Republican-controlled House voted 73-32 mostly along party lines to approve the additional funding to defend the drug testing program.
