The Williamston couple is accused of murdering their adoptive son Ricky.
The judge ruled Monday Tim Holland's statement to investigators, implicating him and his wife in Ricky's death, can be part of the case against him. She ruled part of Lisa Holland's statement, blaming Tim is not admissible.
Those decisions are different than the ones that governed the case when it was a preliminary hearing in the lower court.
Tim Holland's attorney argues that Tim's statements the day he was arrested are part of a plea deal. The judge says that is not the case.
In Lisa's case, her attorney testified about time he waited to be taken to his client while she was being questioned by detectives. As a result, the judge ruled her statements during that time are inadmissible. That's the most substantive 35 minutes of the case.
